
It’s become clear in recent years that the Biden administration cares nothing for the well-being of the American people. Thankfully, Texas Governor Greg Abbott does, and he’s making plans for a new law that proves as much.
Abbott spoke about his plans on a recent episode of Fox News’ Sunday Morning Futures with host Maria Bartiromo. Here, he announced that he would soon sign a bill into law that makes crossing the southern border into Texas illegally a state and not just a federal crime.
“In two weeks, I’ll be signing a new law in the state of Texas that will make it illegal for people to enter the state of Texas from another country illegally and authorizing every peace officer in the state of Texas to arrest those people entering.”
As The Texas Tribune reports, the new law will make crossing into Texas illegally a Class B misdemeanor. Prior convictions will make it a second-degree felony.
To be clear, this will not be a free-for-all on arresting illegals. The law states that there are a number of limitations, including no arrests in churches, healthcare facilities, or secondary schools. Additionally, only those who have illegally crossed in the last two to three years are allowed to be arrested.
Of course, there is a slight problem that I’m sure the federal government or some leftist will try to take to court.
The US Supreme Court has set a precedent that only the federal government has the right to regulate immigration policies. This means there could be a case on the constitutionality of the new law.
However, the constitution also says that each state has the right to enact laws to protect itself and its citizens, particularly when the federal government has either trampled their liberties or not acted within its rights.
It also says that the people, and not the courts, are the ultimate authority on it all. The people are sovereign, not the courts or the US government.
So, no, Texas cannot violate federal. But they may protect themselves without the courts’ permission. And that’s precisely what this law does.
